13. Use of TRIMZY Vacuum Products and Product Responsibility

TRIMZY vacuum products are intended for household use in accordance with their intended purpose and installation and usage instructions.

Products must be installed according to the instructions supplied with the product and/or displayed on our website.

Holding strength may be affected by factors including the type, texture, condition and cleanliness of the surface, moisture, installation method, weight applied to the product and other environmental or usage factors.

Before installation, ensure that the surface is clean, dry, stable and suitable for use with the product.

Do not install the product on surfaces that are not suitable according to the product instructions.

After installation, check that the product is securely attached before placing any item on it.

The product should be checked periodically to ensure that it remains securely attached. If the product becomes loose or its grip weakens, remove it and reinstall it according to the instructions before continuing to use it.

Do not exceed the stated weight capacity of the product.

Do not hang objects in circumstances where their fall or detachment could reasonably cause injury to a person or animal or damage to property.

The product must not be used to support a person, for climbing, as a grab handle, to support body weight or for any purpose other than its intended household use.

Our voluntary warranty or guarantee does not cover damage caused by installation contrary to the instructions, use on an unsuitable surface, exceeding the stated weight capacity, unreasonable or improper use, excessive force, impact, breakage caused by the customer, unauthorised modification or disassembly, normal wear and tear, or use outside the product's intended purpose.

This does not exclude or limit any rights or remedies available to you under the Australian Consumer Law.

To the extent permitted by law, TRIMZY is not responsible for indirect or consequential loss caused by misuse or use contrary to the product instructions. Nothing in these Terms excludes liability that cannot lawfully be excluded.

Product images, videos and visual representations are for illustrative purposes. Minor differences in colours, shades, packaging or non-material aesthetic details may occur.

We may make minor changes to product appearance, packaging or included accessories from time to time, provided those changes do not materially alter the product ordered or its intended function.

14. 30-Day Trial

TRIMZY provides customers purchasing eligible products with a 30-day trial period from the date the order is delivered, subject to the conditions below.

The trial period allows customers to open, install and genuinely try the products in accordance with the product instructions.

During the trial period, you may contact us to request a return for change of mind without needing to provide a reason, subject to the conditions below.

Returning the Full Quantity Purchased

TRIMZY Vacuum Hooks are sold in bundles of 4 units and multiples thereof, depending on the offer selected on the website.

To use the 30-day trial for a bundle, the full quantity purchased as part of that bundle or offer must be returned.

For example:

• If you purchased 4 hooks, all 4 hooks must be returned.

• If you purchased 8 hooks, all 8 hooks must be returned.

• If you purchased 12 hooks, all 12 hooks must be returned.

You cannot keep part of the bundle and receive a partial refund under the 30-day trial unless TRIMZY agrees otherwise in writing.

Condition of Returned Products

Products may be installed and tried during the trial period.

For a change-of-mind return under the voluntary 30-day trial, returned products must be complete, clean and in good condition, allowing for reasonable use necessary to try the product.

Products must not contain damage caused by misuse or unreasonable use, including breakage, cracks, bending, significant scratches, missing components, damage to the vacuum mechanism, permanent dirt or staining, or damage caused by installation or use contrary to the instructions.

All components and accessories required for normal use of the product must also be returned.

These conditions relate only to TRIMZY's voluntary 30-day change-of-mind trial and do not limit your rights in relation to faulty, defective, unsafe, incorrectly described or otherwise non-compliant products under the Australian Consumer Law.

Requesting a Return

We may reasonably request your order number, customer details, photographs and/or video of the products and other information reasonably required to verify the order and assess the return.

Please do not send products back before receiving return instructions from our customer support team.

Once your request has been reviewed, we will provide the applicable return address and return instructions.

Return Shipping

For a voluntary change-of-mind return made under the 30-day trial, return shipping costs are the responsibility of the customer.

We recommend using a tracked shipping service and keeping your shipping receipt and tracking information until the return has been completed.

Where a product fails to meet a consumer guarantee under the Australian Consumer Law, return shipping costs and any applicable remedy will be handled in accordance with the customer's rights under that law.

Inspection and Refund

Once the returned products have been received, we may reasonably inspect them to confirm that the required products have been returned and that the return satisfies the conditions of the voluntary 30-day trial.

A product that is missing or has been damaged through misuse may not qualify for a refund under the voluntary 30-day trial.

This does not affect any rights the customer may have under the Australian Consumer Law.

Where the return qualifies under the 30-day trial, the applicable refund will be processed to the original payment method.

The 30-day trial is an additional voluntary benefit offered by TRIMZY and does not replace, restrict or exclude any rights or remedies available under the Australian Consumer Law.

15. Australian Consumer Law and Consumer Guarantees

Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

Where a product fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund and/or compensation depending on the nature and seriousness of the failure and the circumstances.

TRIMZY's 30-day trial, voluntary warranties, return policies and any other benefits offered by us operate in addition to these statutory consumer rights.

Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

16. Indemnity and Misuse

A user who breaches these Terms or unlawfully uses the website may be responsible for loss or damage caused by their actions to the extent permitted by applicable law.

Nothing in this section imposes liability on a consumer beyond what is permitted under applicable law.

17. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be severed to the extent necessary, and the remaining provisions will continue in effect where legally possible.

18. Termination

These Terms apply while you use the website and its services.

We may restrict or terminate access to the website where reasonably necessary due to a breach of these Terms, unlawful activity, fraud, misuse or conduct that harms the website or third parties, subject to applicable law.

Termination of access does not affect rights or obligations that arose before termination.

19. Entire Agreement

These Terms, together with our Privacy Policy, Shipping & Returns Policy and any other applicable terms displayed on the website, form the terms governing your use of the website and purchases made through it.

Nothing in these Terms limits any right or obligation that applies under applicable law.

20. Governing Law

These Terms and transactions made through the website are governed by the laws applicable to TRIMZY's business operations, subject always to any mandatory rights and protections available to consumers under the Australian Consumer Law and any other applicable Australian laws.

Nothing in these Terms is intended to exclude or restrict any mandatory consumer right, remedy or jurisdiction available under applicable law.

21. Changes to These Terms

We may update these Terms from time to time.

Updated Terms will take effect from the date they are published on the website unless otherwise stated.

Changes will not apply retrospectively in a way that removes rights already acquired under a completed transaction, except where permitted or required by law.
